1. AO-SI STATUS
AO-SI’s mission is the complete transition from the old, contracted reality to the new, sovereign reality, based on the Law of Harmony. To accomplish this mission, two AO-SI legal entities have been established, each serving a distinct purpose. Together, they form the AO-SI Entrepreneurship Pillar in the Transition Phase.

2. PURPOSE OF THESE GENERAL TERMS AND CONDITIONS
The purpose of these General Terms and Conditions is to define the framework within which donations are made for the various AO-SI Foundation Projects.
This policy applies to all donations, bequests, fundraising activities and to anyone who is involved in raising and collection of funds and to anyone who voluntary helps sharing the AO-SI Mission and its world-changing Project to others (people or organizational entities).
3. DEFINITIONS
In these General Terms and Conditions, the following terms will have the following meanings:
- General Terms and Conditions : these General Terms and Conditions;
- Bequest : means a donation of cash, property or other resources by will of codicil
- Contract : the contract concluded between the Donee (non-profit AO-SI Foundation Association) and the Donor (you) whereby the Donor makes a Donation in favor of the Donee and which is confirmed in the following contractual documents: (i) the electronic Form (where applicable), (ii) these General Terms and Conditions, (iii) the Description (where applicable);
- Description : the description of the project communicated to the Donor (if any);
- Donation : means voluntary contribution or gift, whether in cash, in real estate or kind which is the subject of the Contract. Donations will have the characteristic that its payment or transfer is made voluntarily;
- Donee or AO-SI FOUNDATION or us: the non-profit AO-SI Foundation, whose registered office is in Belgium, and which is registered with the Crossroads Bank for Enterprises under number 1031.681.112
- Donor or you: means any natural person or private or public organization who makes a Donation in favor of the Beneficiary under the Contract;
- Donor’s Data : the personal data of the Donor communicated by the Donor by telephone, by electronic form (if applicable) or by post;
- Electronic Form : the electronic form accessible via the website or the electronic e-mail correspondence Form in which the Donor (i) communicates the Donor’s Data to the Beneficiary, (ii) determines the amount of the Gift, (iii) determines the method of payment for the Gift and, where applicable, (iv) authorizes the Beneficiary to collect future Gifts by debiting the Donor’s bank account in accordance with articles 5.2 and 5.3 of the General Terms and Conditions ;
- Financial Gift: the sum of money or kind which is the subject of the Contract;
- Fundraising activity : means all activities undertaken by or on behalf of the AO-SI Foundation with the aim of receiving donations
- Fundraising Event : an event organized by a fundraise volunteer, authorized by the AO-SI Foundation to use its logo and communication material.
- Fundraising Volunteer or You : means any natural person or private or public organization who is aligned with the AO-SI Mission and voluntary, and on its own will & responsibility organizes a fundraise event to collect money with the goal to make a Donation in favor of the Beneficiary under the Contract; A Fundraising Volunteer acts on its own responsibility whereby its time and its effort as a volunteer are being donated to support A-UM, without contemplation of compensation of any kind of benefits whatsoever (reimbursement of costs, insurance cover, personal favors, A-UM products and/or services, requests for employment, wages ).
- Privacy Statement : the privacy statement accessible via https://www.ao-si/privacy-policy/;
- Party : the Donor and/or the Beneficiary.
- Will : refers to a legal declaration of a person’s wishes regarding the disposition of their property after death
4. SCOPE OF APPLICATION OF THESE GENERAL TERMS AND CONDITIONS
- Unless explicitly agreed otherwise in writing between the Parties, these General Terms and Conditions apply to all Contracts entered into between the AO-SI Foundation Association and you.
- These Terms and Conditions will apply to all future Contracts between the AO-SI Foundation Association and you, even if the AO-SI Foundation Association does not refer explicitly to these Terms and Conditions in the context of future Contracts.
- In the event of any discrepancy between the provisions of the various contractual documents forming the Contract, the order of precedence shall be as follows (in descending hierarchical order): (i1) the electronic Form, (ii) the Description, (iii) these Terms and Conditions.
5. DESCRIPTION OF THE FRAMEWORK IN WHICH THE DONATIONS ARE MADE
5.1. DONATION
When you decide to make a Donation to AO-SI, the non-profit AO-SI Foundation Association will collect the Data relating to you that is necessary for the realization of such Donation. Your Data will be collected :
- by telephone or any other electronic medium.
- via bank details for donations via bank transfer
- by telephone or any other electronic medium.
- via post – registered mail for donations via payable check
- via the electronic Form if accessible on the AO-SI.WORLD website (General Donation Form, Major Gifts Donation Form, Organization Donation Form, In Memory Donation Form), The website is hosted by our hosting provider.
AO-SI communicates with the Donor given through e-mail correspondence or released by telephone, any other electronic medium or through the e-mail address that he/she has indicated in the Electronic Form if accessible.
5.2. ACCEPTANCE DONATIONS
The non-profit AO-SI Foundation Associations accepts Donations from any natural person, private or public organization.
The non-profit AO-SI Foundation Associations accept donations of cash, publicly traded securities, real property, personal property and other approved forms of in-kind gifts. Real property, personal property, in-kind gifts, non-liquid securities, and contributions whose resources are not transparent of whose use is restricted in some manner, will be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose of the non-profit AO-SI Foundation Associations. Where an offer of a donation is not accepted, management will determine the appropriate manner in which to convey to the donor AO-SI’s decision.
The non-profit AO-SI Foundation Association accepts donations via a variety of methods including : bank transfers, payable cheques, cash, resources, if accesible also via online payments (via Mollie Payment gateway – paypal, credit cards, direct deposit, debit cards), and other approved forms of in-kind and bequest donations.
The non-profit AO-SI Foundation Association will process donations in timely manner, in accordance with relevant legislation, and will issue a receipt if requested .
The non-profit AO-SI Foundation Association will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the non-profit AO-SI Foundation Association will restrict information about the donor to only those staff members with a need to know.
The non-profit AO-SI Foundation Association will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.
The non-profit AO-SI Foundation Association accept donations from a minor. A minor can also make a Donation or organize a Fundraising Event with the express permission of an authorized parent or guardian. When a minor makes a donation and he/she accepts the Terms and Conditions Agreement, the non-profit AO-SI Foundation Association requires that all the points described in the Agreement have faithfully and accurately been observed.
5.3. PAYMENT FINANCIAL GIFT
- A single Financial payment gift will be made by the method of the Donor choice from the payment options proposed by the non-profit AO-SI Foundation Association. For the moment only via bank transfer or by sending a payable check via registered mail to AO-SI Foundation. If accessible, via online payment form whereby the payment methods for online payment are paypal, credit card, bank transfer or debit cards.
- If the Donor chooses to make a donation by payable cheque, please contact architect@ao-si.world. In this way the AO-SI Foundation will communicate all the necessary details where to send the payable cheque to. The AO-SI Foundation cannot be held liable in case of loss during the sending procedure.
- In case the Donor choose to donate a single Financial Gift by our various online payment forms – if accessible| For the moment this Service is not active. (General Donation Form, Major Gift Donation Form, Organization Donation Form and In Memory Donation Form), a confirmation e-mail of the donation with receipt will be send to the donor subscripted e-mail address with a link to the personal Donation Dashboard. From here the Donor can download a pdf receipt and consult its one-off donation. | This Service is not available for the moment.
5.4. COLLECTING GIFTS BY ORGANIZING A FUNDRAISE EVENT
Solicitation of donations may be undertaken through organizing a Fundraising Event. Approval to solicit donations referring to the AO-SI Foundation must be approved from the AO-SI Foundation management and be within the parameters as set by this general terms and conditions agreement.
Staff, Fundraising Volunteers and other partners wishing to undertake the soliciting of Fundraising Events referring to AO-SI must seek approval by contacting the AO-SI Foundation Association. Requests can be done by sending an e-mail to architect@ao-si.world. Requests should outline the description and content of the event, the venue and date where it will take place. The general terms and condition agreement must also be accepted.
A minor can make a donation via the organization of a fundraising event with the express permission of an authorized parent or guardian. In that case, the minor will receive a registration form after its application, for which we request authorization from an authorized parent or guardian.
When a request to organize a Fundraising Event is received, an assessment of validation is done. By approval, the Fundraising Volunteer can receive online communication and presentation material from the AO-SI Foundation Association.
The AO-SI Foundation requires that the following standards be complied with in any fundraising event activity undertaken :
- all statements must be truthful and accurate;
- include the AO-SI Foundation’s identify and purpose (including website and address);
- state what the donations are collected for and what they will be used for;
- use of photographs which are misleading that could create a false impression for misunderstanding are not permitted.
The AO-SI Foundation requires that any Promotion Material used to promote a Fundraising Event :
- is actually accurate, truthful and not likely to deceive or mislead any person;
- correctly identifies AO-SI;
- identifies the objectives of the Fundraising Event;
- has the approval of the AO-SI Foundation Association;
- be part of a positive communication to build public awareness, understanding and support to the AO-SI Mission;
- complies with the relevant national legislation in connection with fundraising events.
In case of violation of the points described above in section 5.4, the AO-SI Foundation has the right to make a claim for any kind of damage related to its Identity (Mission & Corporate Values, Corporate Image) and to claim financial or other compensation for the damage suffered.
Once the Fundraising Event is done and the money is collected, the Fundraising Volunteer can donate the collected Financial Gift cash, by direct bank transfer (IBAN BE 35 1036 0525 7537 – BIC NICABEBB).
5.6. MANDATE
The mandate as provided for in the previous article of these General Terms and Conditions can be revoked by both Parties, and this (i) in your case only by sending an e-mail to the AO-SI Foundation Association (architect@ao-si.world). In the e-mail the motivation of the revocation must be present. Any request of revocation of the mandate by a Donor and any associated costs will be assessed on a case-by-case basis. When a request for a revocation of the mandate as provided for in the previous article of these General Terms and Conditions is received, an assessment of the reason for the withdrawal will be undertaken.
5.7. CONCLUSION OF CONTRACT
- Each Contract will be concluded at the moment when the Financial Gift Donation, in whole or in part, enters the bank account of the non-profit AO-SI Foundation Association.
- Each Contract will be concluded at the moment when the Bequest Donation in favor of the non-profit AO-SI Foundation Association, in whole or in part, becomes legally a legal propriety of the non-profit AO-SI Foundation Association.
- A-UM reserves the right to subject the validity of the Contract to other conditions, e.g. in the case of donations made by minors or donation via will.
- In accordance with Article 894 of the Civil Code, the donation is an irrevocable deed, without prejudice to Articles 5.2 and 5.3 of these General Terms and Conditions. A refund may be granted at the request of the Donor and at the sole discretion of the non-profit AO-SI Foundation Association.
6. INTELLECTUAL PROPERTY
All Intellectual Property rights of the non-profit AO-SI Foundation Association, disclosed by the non-profit AO-SI Foundation Association under the Contract, in any form whatsoever, shall remain the sole property ofthe non-profit AO-SI Foundation Association. Any reproduction or use thereof without the non-profit AO-SI Foundation Association’s prior written consent is expressly prohibited and may give rise to a claim for damages from the non-profit AO-SI Foundation Association as well as the application of any other sanctions at the non-profit AO-SI Foundation Association’s discretion.
7. GUARANTEES
You guarantee that the Data related to you, which has been submitted to the non-profit AO-SI Foundation Association, is correct.
8. LIABILITY AND COMPENSATION
- The limitations of liability agreed below do not apply if they are contrary to mandatory statutory provisions or provisions of public order.
- Regardless of the legal basis, the Parties shall only be liable for damage resulting from their own intentional or grossly negligent fault.
- Under no circumstances can the Parties be held liable for any indirect, incidental, punitive, accessory or consequential damages, such as, among others, loss of profit or income, loss of turnover, costs for business interruption or loss of customers.
- Each Party’s liability to the other Party shall be limited to the equivalent of 100% (one hundred per cent) of the sums paid by the Donor to the Donee under the Contract, irrespective of the nature of the claim and irrespective of whether it is a claim in contract, a claim per delict title, a claim under a warranty or for any other reason.
- The exclusions of liability of the Donee set out in the preceding paragraphs shall also apply to the liability of its staff, employees, agents, consultants, representatives, vicarious agents, suppliers and deliverers (if any).
9. PROTECTION OF PERSONAL DATA
By entering into the Contract, you accept that your Data will be processed bythe non-profit AO-SI Foundation Association for the purposes of performing the Contract. 10. FINAL CLAUSES
- Any dispute arising from the contractual relationship between the Donee and the Donor falls within the exclusive jurisdiction of the courts of Hasselt, Belgium. .
- Without prejudice to applicable foreign laws of public order or imperative foreign laws, Belgian law shall apply to the contractual relationship between the Donee and the Donor.
- If one or more provisions of the Contract are declared wholly or partially invalid, unlawful or unenforceable, the validity, lawfulness and enforceability of the other provisions of the Contract shall not be affected thereby. In such a case, the Parties undertake to replace such totally or partially invalid, illegal or unenforceable clause with a valid, legal or enforceable clause that most closely approximates the purpose of the invalid, illegal or unenforceable clause with retroactive effect.
- The Contract constitutes the entire agreement between the Parties and supersedes all previous agreements related to the subject matter of the Contract.
- All obligations under the Contract which, by their nature, continue after the end of the Contract, shall continue after the end of the Contract.
- The Parties are independent and agree that the Contract in no way creates a relationship of agency or partnership between them. No provision of the Contract shall be construed as creating a relationship authorizing one Party to act or give warranties on behalf of the other, save as expressly provided in the Contract.
